Step 9 When Buying a Home In Phoenix, Arizona.

There are 13 steps to buying a home in Phoenix, Arizona.  We are now to the 9th step!
Once you have had the inspection done on your Arizona home it is time to negotiate repairs.
In Arizona we use a standard Arizona real estate form to do this.  The form is called the "Buyer's Inspection Notice and Seller's Response".
This process is fairly straight forward, but let me give you a little background information so that you will understand it more fully.
In the standard Arizona real estate contract a buyer is given a 10 day inspection period to inspect the home they plan on buying.  During that time I will hire an inspector for you to do a general inspection.
Once the inspection has happened it is time for us to decide what you want to ask for in the "Buyer's Inspection Notice and Seller's Response."
In the standard Arizona real estate contract there are four things that a seller guarantees will be in working condition.  They are heating, air-conditioning, plumbing, and electrical. 
If any of these items are not in working condition we would ask that they be repaired in the "Notice of Non-Working Warranted Items" section.  This is where it states that the "Seller remains obligated to maintain or repair warranted items as provided in Section 5a of the contract". 
Meaning that if any of the four items warrented items are not in working condition the seller must get them in working condition!
All other items that you want to have repaired or replaced you would ask for under "Items Disapproved:" This is where you can ask to have the heater or air-conditioner serviced, to have the garbage disposal replaced or whatever else is important to you. 
You and I will need to complete the "Buyer's Inspection Notice and Seller's Response" during the 10 day inspection period.
Once I have delivered the "Buyer's Inspection Notice and Seller's Response" to the seller's, they will have 5 days to respond to our request.
During the 5 days they will have three options to respond with.  They are 
  1. Seller agrees to correct the items disapproved by Buyer pursuant to terms set forth herein and Section 6j of the Contract.
  2. Seller is Unwilling or unable to correct any of the items disapproved by Buyer.
  3. Seller's response to Buyers Notice is as follows:
Once you and I have receivedt the "Buyer's Inspection Notice and Seller's Response" we will have three days to respond to the sellers repair response.
It is important to remember that in Arizona if the seller does not agree to service, repair, or replace everything that you the home buyer asks for you will be able to cancel the contract.
Once we have received the response from the seller as to what they will do, we will have three days to respond in writing either canceling the contract or accepting the seller's response.
This step, step 9 in buying a home in Phoenix is an ongoing process during escrow.
Step 10 is Pack and Schedule Utilities will be the next step.
