Vote NO On Proposition 201
Under the current law in Arizona there are several ways a buyer and seller can resolve disputes regarding design, construction, and condition of a home prior to filing a lawsuit. Proposition 201 makes several changes to this process.
Specifically, proposition 201 will mandate requirements which include litigation rights in dwelling action to "prospective buyers." It will eliminate the "loser pays" statutes that currently govern residential claims.
Proposition 201 will make it so that plaintiffs are eligible to recover attorney's fees, but defendants are not. Prop 201 also expands the monetary damages that a plaintiff can collect in a lawsuit.
Under this proposition buyers would have the right to rescind a contract within 100 days after signing.
Arizona's proposition 201 would also extend the time frame in which a person can sue over any real property improvements.
In my opinion proposition 201 will create more bureaucracy, but it will not create better homes in Arizona. Prop 201 will also create biased laws that will encourage lawsuits between buyers and seller.
Vote No on proposition 201!
